Welcome to the Winek application.

This Privacy Policy has been prepared taking into account the requirements of Google Play relating to the protection of user data, and in accordance with the provisions of Algerian Law No. 25-11 dated July 24, 2025, amending and supplementing the legislation relating to the protection of natural persons in the field of personal data processing.

[Trans App Limited], the owner and operator of the Winek application, is committed to protecting users’ privacy and processing their personal data in a lawful, transparent, and secure manner, in accordance with the applicable legislation, in particular the provisions of Algerian law relating to the protection of natural persons in the field of personal data processing, as well as the requirements of publishing platforms, including Google Play requirements relating to user data and processing transparency.

This policy explains the types of data we collect, the purposes for which we use it, how we share and protect it, how long we retain it, and the rights available to the user, including the right to request deletion of the account and the data associated with it.

By using the Winek application or creating an account within it, you acknowledge that you have read and understood this Privacy Policy, and you agree to the processing of your data within the limits necessary for the operation of the service, in accordance with applicable law.

2. Nature of the Application

Winek is a digital platform intended to connect passengers with drivers and transport service providers, facilitate ride requests, display offers, determine pick-up and drop-off locations, and organize operational communication between the parties within the application.

Winek does not provide transportation services directly. It acts as a technical and organizational intermediary between users, in accordance with the rules and features available within the application.

3. Data We Collect

We may collect and process the following data depending on the account type, nature of use, and permissions granted by the user to the application:

A. Identification and Account Data

This may include:

First and last name or display name within the application.

Phone number.

Email address, if any.

Verification code or account confirmation data.

Account type, such as passenger, driver, or service provider.

Profile photo, if provided by the user.

Account status, such as active, suspended, rejected, or under review.

B. Driver or Service Provider Data

If the user is a driver or service provider, we may collect additional data necessary to verify identity and eligibility, such as:

Driver’s license data or activity license data, where applicable.

Vehicle data, such as type, color, year of circulation, activity area, and work scope.

Vehicle photos uploaded by the user.

Data from documents required for verification, such as insurance or professional documents, where necessary.

The status of file acceptance, rejection, or request for review.

User ratings related to the service.

Sensitive documents, registration numbers, or private documents are not displayed to the public unless this is legally or operationally necessary and within the permitted limits.

C. Geolocation Data

The application may collect geolocation data when permission is granted, including:

Pick-up location.

Drop-off location.

Current location while using the application.

Driver’s location while searching for a ride or performing it.

Approximate route of the ride.

Geographical area, wilaya, or municipality linked to the service.

Location data is used to enable ride requests, suggest nearby drivers or requests, calculate distance, improve service accuracy, and activate security and operational features.

Some application functions may be unavailable or may appear incomplete if geolocation permission is disabled.

D. Ride and Transaction Data

We may collect data related to requests and rides, such as:

Ride requests.

Offers and proposed prices.

Final agreed price.

Time of creation, acceptance, rejection, cancellation, or completion of the request.

Pick-up and drop-off location.

Ride duration and approximate distance.

Ride status.

Passenger and driver ratings.

Data relating to complaints or reports concerning the ride.

E. Payment and Subscription Data

If the application provides paid services, subscriptions, or operational fees, payment-related data may be processed, such as:

We do not store full bank card details within the application. Payment transactions may be processed through approved payment service providers subject to their own security policies and terms.

5. Legal Basis for Data Processing

The processing of personal data is based on one or more of the following grounds:

The user’s consent when creating the account or granting permissions.

The necessity of processing to perform the service requested within the application.

Legal or regulatory obligation, where applicable.

Legitimate interest in protecting the application and users, and preventing fraud and abuse.

The necessity of processing to manage complaints, disputes, or protect legal rights.

6. Application Permissions

The Winek application may request certain permissions necessary for the operation of its features, such as:

Geolocation permission.

Notification permission.

Camera permission when taking verification photos, document photos, or vehicle photos.

Access to photos or files if the user chooses to upload an image or document from their device.

Any other permissions related to the application’s features.

These permissions are used only within the limits of the purpose for which they were granted. The user may modify them from the device settings, noting that disabling certain permissions may affect the operation of some features.

7. Sharing Data with Third Parties

The Winek application does not sell users’ personal data to any third party.

Data may be shared, within necessary and lawful limits, with the following parties:

Hosting, server, and storage service providers.

Mapping and geolocation service providers.

Notification service providers.

Analytics and performance improvement service providers.

Electronic payment service providers, where applicable.

Other parties within the ride, such as sharing certain passenger data with the driver or certain driver data with the passenger to the extent necessary to perform the ride.

Data is shared only to the extent necessary to provide the service, comply with the law, or protect users and the platform.

8. Visibility of Certain Data to Other Users

Depending on the nature of the service, certain data may be visible to other users within the application, such as:

Driver’s name or nickname.

Vehicle type, color, and year of circulation.

Activity area.

Driver or passenger rating.

Proposed or final price.

Pick-up and drop-off location during the ride.

Driver status or request status.

Data necessary for operational communication within the application.

Users must not misuse any data displayed to them within the application or use it outside the purpose for which it was displayed.

9. Data Protection

We adopt reasonable technical and organizational measures to protect personal data against:

Misuse.

Hacking or disruption attempts.

Request deletion of the account and associated data, where legally possible.

We may request additional information from the user to verify their identity before fulfilling certain requests, in order to protect the account and data against unauthorized requests.

12. Account and Data Deletion

The user may request deletion of their account and associated data through one of the following means:

When an account deletion request is submitted, we will process the request within a reasonable period, and we may request information to verify the identity of the account holder before carrying out the deletion.

Protect the rights of users or the platform.

Resolve existing disputes or complaints.

Retain financial or operational records required by law.

After the reason for retention ends, the data will be deleted or anonymized according to the adopted procedures.

Notifications of request acceptance or rejection.

Subscription or expiry alerts.

Technical support messages.

Important update notifications.

The user may control certain notifications from the application settings or device settings, noting that disabling notifications may affect the user experience.

14. Children and Minors

The Winek application is not intended for children.

The application may not be used by children or minors in a manner that violates applicable laws or without the consent and accompaniment of the legal guardian when required.

We do not knowingly collect personal data from children in a manner that violates the law. If we discover that a child’s data has been collected without a valid legal basis, we will take appropriate measures to delete it or restrict its processing.

It is also strictly prohibited to use the application to transport children under the legal age without the accompaniment of their legal guardians, in accordance with the application’s Terms of Use and applicable laws.

15. Third-Party Services

The Winek application may rely on technical services provided by third parties, such as:

Mapping and geolocation services.

Hosting and storage services.

Analytics and performance services.

Notification services.

Electronic payment services.

Crash detection and security improvement services.

These services may process certain data to the extent necessary for their operation. We strive, as far as possible, to work with service providers that adopt appropriate data protection measures.

Some data may be hosted or processed through servers or service providers located inside or outside Algeria, depending on the technical infrastructure adopted for the application.

In the event of data transfer or processing outside the national territory, this is carried out within the limits permitted by law, taking into account the necessary measures to protect the data and ensure that it is not used outside the purposes defined in this policy.
