Welcome to the Winek application.
Please read these Terms of Use carefully before using the application or creating an account. By using or registering on the Winek application, you expressly and fully agree to comply with these terms and conditions.
1. Acceptance of the Terms of Use
1.1. Your use of the Winek application constitutes full and final acceptance of all the terms and conditions set out in this document.
1.2. If you do not agree with any provision of these terms, you must stop using the application immediately.
1.3. Your continued use of the application after any update or amendment to these terms constitutes acceptance of the modified version.
2. Nature of the Service
2.1. The Winek application provides a digital platform designed to connect passengers with drivers and transport service providers.
2.2. The application facilitates ride requests, displays offers, allows price proposals, and organizes the agreement between the passenger and the driver within the platform.
2.3. Winek does not provide transportation services directly and is not a transport company. It acts solely as a technical and organizational intermediary between users.
2.4. The final relationship relating to the execution of the ride remains between the driver and the passenger. The role of the application is limited to facilitating the connection and technical organization.
3. Account and Responsibility
3.1. The user agrees to provide accurate, correct, and up-to-date information when registering or using the application.
3.2. The user is fully responsible for maintaining the confidentiality of their account, phone number, verification code, and login credentials.
3.3. Any activity carried out through the account is deemed to be the direct responsibility of the account holder.
3.4. The user is prohibited from sharing their account with any third party or allowing anyone else to use it.
3.5. The application administration reserves the right to request verification of certain data or documents when necessary, especially for drivers and transport service providers.
4. Prices and Payment
4.1. The passenger may propose a price for the ride, provided that it is not lower than the minimum amount approved within the application.
4.2. The driver has the right to propose the price they deem appropriate, according to the mechanism adopted within the application.
4.3. The final price is agreed upon between the driver and the passenger through the system available within the application.
4.4. Where applicable, the application may include subscriptions, service fees, commissions, or other operational fees, which shall be clearly displayed within the platform.
4.5. The user is responsible for reviewing the price or fees before confirming a request or accepting an offer.
5. Permitted and Prohibited Conduct
5.1. All users agree to use the application in a legal, safe, and respectful manner.
5.2. Users are prohibited from carrying out any of the following actions:
5.2.1. Using the application for any illegal purpose or in violation of public order or public morals.
5.2.2. Abusing drivers, passengers, or service providers in any way, whether verbally, morally, through threats, harassment, or any other abusive behavior.
5.2.3. Transporting children under the legal age without the accompaniment of their legal guardians, even if the driver holds a taxi license or any other professional authorization.
5.2.4. Entering false or misleading information or using invalid documents.
5.2.5. Circumventing the system or exploiting the application in unlawful ways.
5.2.6. Attempting to disable, hack, or affect the application, its technical infrastructure, systems, or servers.
5.2.7. Using the application in a way that harms other users or damages the reputation of the platform.
5.2.8. Making agreements outside the application with the aim of abusing the service or bypassing its operational rules.
5.2.9. Using other users’ data outside the purpose for which it was displayed within the application.
6. Geolocation
6.1. The Winek application needs access to the user’s geolocation in order to operate certain essential features.
6.2. Location data is used to determine the pick-up point, drop-off point, display nearby rides, suggest suitable drivers or requests, and improve service accuracy.
6.3. Some application features may be unavailable or may function incompletely if geolocation services are disabled.
6.4. The user agrees not to provide false or misleading locations that may affect the execution of the ride or the safety of the parties.
7. Winek’s Responsibility
7.1. The Winek application shall not be directly responsible for the behavior of the driver or the passenger during or outside the ride.
7.2. The application does not guarantee permanent availability of the service or that it will always be free from interruptions, failures, or technical errors.
7.3. Winek shall not be responsible for any agreements made between users outside the system adopted within the application.
7.4. Winek’s role is limited to providing a technical and organizational platform to facilitate the connection between users and the management of requests within the application.
7.5. The application reserves the right to take appropriate measures to protect users and the platform in the event of reports, violations, or unlawful use.
8. Account Suspension or Deletion
8.1. The administration of the Winek application reserves the right to suspend, restrict, or delete any account in the event of a violation of these Terms of Use.
8.2. This includes, but is not limited to, illegal, fraudulent, or abusive behavior, providing false data, or attempting to harm the application or its users.
8.3. The application may take immediate action without prior notice in serious cases or when the safety of users or the security of the platform is threatened.
8.4. A driver’s or service provider’s account may be rejected or suspended if it does not meet the verification requirements or if a substantial violation is committed.
9. Amendments to the Terms of Use
9.1. The Winek application reserves the right to amend or update these Terms of Use at any time.
9.2. Users will be notified of any substantial amendments through the application or by any appropriate means.
9.3. Continued use of the application after the publication of amendments constitutes implicit acceptance of the updated terms.
